Disclaimer: This document is a summary of the IRMA Coverages and is intended for informational purposes only. It is not a complete statement of the IRMA Coverage documents and does not amend, extend or alter the coverages provided to the Member. This document is subject to all terms and conditions of the IRMA Bylaws and Coverage Document, and any applicable contract(s) of commercial insurance. In the event of a discrepancy between this document and the IRMA Coverage Documents or any applicable contract(s) of commercial insurance, the terms and provisions of the IRMA Coverage Documents and any applicable contract(s) of commercial insurance shall govern.

Public Officials Liability Coverage
($10,000,000 per wrongful act)

Employment Related Coverage – bodily injury emotional distress, mental anguish, damage to or destruction of property, including diminution of value or loss of use as a result of:

  • Refusal to employ;

  • Termination of employment; or, demotion, evaluation, reassignment, discipline, defamation, harassment, humiliation, discrimination or other employment related practices or wrongful acts.

Employee Benefits Liability – injury or damage resulting from the administration of the Member's Employee Benefits Programs General Liability Coverage

Exclusions Applicable to all Coverages:

  1. Punitive Damages
     

  2. Intentional Acts- damages or injuries expected or intended from the acts of the Member, done by or at the direction of Member; acts that are outside the scope of employment or authority of the Member or employee
     

  3. Dishonest, criminal or fraudulent acts; gaining profit or advantage to which Member is not entitled.
     

  4. Pollution (except for herbicide or pesticide application or chlorine release related to water and wastewater treatment)

Pollutants are defined as any solid, liquid, gaseous or thermal irritant or contaminant, including smoke, vapor, soot, fumes, acids, alkalis, asbestos, chemicals and waste. Waste includes materials to be recycled, reconditioned or reclaimed.

  1. War
     

  2. Contract Actions – actions grounded solely in contract, i.e. breach of contract
     

  3. Non-Monetary Claims – i.e., injunction, mandamus, declaratory relief
     

  4. Condemnation, eminent domain, inverse condemnation by whatever name called
     

  5. Causes of action seeking front pay, back pay and retroactive salary increases or employment benefits.

Defense Provisions

The IRMA Coverage document provides that if there is no coverage for a claim, there is no obligation for IRMA to provide the Member a defense. However, in certain circumstances, IRMA will provide the Member a defense in situations where they might not otherwise be entitled to a defense.

Unified Defense – in cases where there is a mixture of covered claims and non-covered claims (which normally would not be entitled to a defense), IRMA will provide the Member a defense for all the claims at IRMA expense.

Intent to Injure Defense - in cases where coverage is precluded by a specific allegation of intent to injure or intentionally cause injury, and where the Member denies these allegations, IRMA will initially provide a defense by IRMA counsel at IRMA’s cost. However, if the specific allegation of intent to injure which precludes coverage is proven to be true by evidence or settlement, IRMA will require that the Member reimburse IRMA for any expenses, fees or defense costs incurred prior to that judgment, settlement or final adjudication.

The member may choose to retain its own separate counsel with respect to the allegations of intentional conduct or intent to injure; however, it does so at its own expense without reimbursement by IRMA
